Well, more power to 'em if they do that and I hope that they do, but I can't see them getting it past the NHTSA people, unless they could maybe classify it as a motorcycle? In the UK it would be classified as such, as it only has three wheels.
 
It would be classed as a motorcycle, unless I miss my guess. Three wheels turns that trick, that was why the late Corbin Motors only produced three wheelers. I think this would have a better bet being a 2 seater. That was the only thing that kept me from snatching up a Merlin.
 
If it's only registered as a motorcycle, you'd be required to wear a helmet in most states. No need for a windscreen.
