Really? Guess we got to wait then.

But I find it hard to believe you can not put it on a T shirt.

Funny you should mention t shirt. That was I was researching when I found the 99 year deal. IIRC, it should be under the copyright section of the US gov site.

Artist wife just said no stautue of limitations on artwork. Yiou can copy for self, but not for sale.

She said all artwork automatically carries an "implied" copyright.

I think the Picaso family caused a big stink a whiole back about unauthorized copies.....but I could be wrong.

Would be a headache with all the company trading that has happened.
I'll bet British Motor Heritage would know the procedure.

Kurt.

How about paintings of cars and such for sale? I'm not sure I believe all that I am hearing.

How about all the stuff they put on T shirts.

How about my Hat with the Austin Healey on it. Something is wrong here.

Trevor, that is gorgeous work but I have a question. Is there any copyright problems with using those emblems on a commercial product???? Wouldn't want to see you get in a jam and don't know how that stuff works myself. I was thinking of making up some better sports car caps years ago worried about that. Caps are no longer made here anyway so the problem isn't of concern now.

Kurt.

I would say that is a big fat "don't worry about it", if it was a issue, Trevor would have to stand in line to get sued, and who might actaully be the one to sue him, would be the bigger question. For example VTO has MG center cap logos made for the wheels we sale, Datsun and Triumph logos as well. GM tried this years ago with their Chevy logo and such, which is slathered on any and everything aftermarket one could imagine, from car parts to t shirts to hats, if GM could not make suit stick, then no one can, then there is Harley Davidson, another logo put on nearly everything one could imagine. I think Trevor would never lose a wink over worrying about this, in fact it is almost laughable, we are even talking about it.

At the Euro show this weekend, there was well known vendor there they are known for selling popular items with your favorite car branding on them, many who are still active compaines, you name it, key fobs, hats, t shirts, decals, does one actually think, he is paying royalties to someone for that and since this is their primary business, and they make a living doing it, this would be much greater threat than someone make a few branded air cleaners, you know a suit has to be plausible has to be based on profit, can you see a corporate lawyer showing up at Trevor's door, wanting the $50 he made off selling a few items, excuse me while I spit coffee on my keyboard laughing  :jester:

For what is is worth, I have two Cafe Press shops, both have MG and AH logo items on them, and I sleep good at night, even known to snore, according to my wife

Guess you have a good point, Hap. I'm overly paranoid in the litegous country we live in today. Unfortunatly I didn't get your advice back when I could have had caps made to my specs by english speaking folks that were only an hours drive away.
Oh well! I really didn't have the time to fool withit anyway.

Kurt.

Kurt, you can still make your hats, t shrts or whatever you want, I love Cafe Press, because I can make whatever I want and just buy one, you can even keep your Cafe Press shop private and not opened to the public. Some of my favortite MG hats are my Cafe Press hats. YOu can make some pretty cool stuff there, for example your own calendar with pictures of your car, t shirts, hats, mouse pads, dog shirts, you name it, you can personlize whatever you want. Everything I got from Cafe Press so far has been great quailty, in fact their calendar arealot better then some of the one the MG cubs have had made, much better paper and photo quailty, and I only had to make and buy one calendar.

My Cafe Press shops are open to the public, I use it as way to have Acme Speed Shop swag without having to invest hundreds of dollars. Occasionally I get a check in the mail from them for $25-50, but mostly I use my Cafe Press bucks to buy hats and t shirts with form them

One of the Cafe press print shops is here in Louisville.

Well folks what I had in mind was more than just a logo. I farm for a living and one thing salemen always gave out was a good quality cap. The ones I've always wore when top down had a full mesh top that lets tha air blow thru. These hats stayed on your head and kept you cool and comfy. Made by K products company that was local and willing to make some modifications( mainly to the bill) for me. Company has gone to China!! Hats are cheapened up of course!

Kurt.

Kurt, IIRC I saw some hats like that made from seagrass in FL not long ago.

Hehehe, try that with NFL stuff and see what happens. IIRC, big auto manufactures were making a stink over logos and names use on websites. Supposedly you had to have a disclaimer at the bottom of the page saying you weren't affiliated or something like that. Sounds like the lawyers needed to bill some hours.

For all I know he might get sued by BGA ( Broccoli growers of America) or the Jolly Green Giant.

It's amazing what you can do with CNC stuff. Such detail. My mother has two embrodery (sic?) machines and makes all kinds of stuff. She'll gonna do MG logos on the best jacket ever made for me once I get another one. My race team jacket was the best jacket I ever owned. It beat my Navy issure Pea coat hands down. WEll, at least beat it in function not style. Too much dog hair in my house to wear black kersey wool.

The rights to the logos are controlled by British Motor Heritage and are not in the public domain. I looked into this a while back and this is the response I received.

Richard,
Thanks for the email.

Basically you would need to have a licensing agreement in place which specifics what products you are authorized to manufacture, where you can sell them and the royalty that is paid back to BMH for those rights (typically 10% of your sales). Additionally, all products will need to be pre-approved by BMH prior to sale. Lastly, there are royalty commitments that need to be paid to BMH, called Guarantees. You would need to ‘guarantee’ a certain amount of sales (or royalties) be paid to BMH on an annual basis. So in essence you are prepaying the first portion of your royalties to BMH.

We’ve done deals in the past for $1500 per year guarantees (e.g., $15K in sales), but I am not sure they are looking to continue to strike these smaller deals.

If you feel that you can make some significant sales, let me know and I can get the ball rolling.

If these numbers are too large for you, I can put you in touch with an existing BMH licensee (who makes embroidered shirts and hats) and who can probably make the chairs for you (we would need to add this product category to his rights though). Thus, he would be responsible to handle all the royalty payments to BMH. I assume you would need to guarantee him a number of orders though.

Happy to answer any other questions you have. Feel free to call.

Best,

D

As others have said I think if you made something for a small group you may be too small of a fish to go after. I just wanted to clear up the question of who controls the rights to the British Motor Heritage Marques.

I'd buy those filter covers in a skinny minute if they'd fit my application.
VERY cool.
Nicely done.

You know we have an advertiser here that makes super filters.

I forgot about them Jack. A note on their website says that they are no longer manufacturing parts. Do you know what happened? They certainly had some nice stuff.

I wonder if just the name is covered under any of that?

My request was for information for uses of the logos.

Maybe Trev can start calling himself Austin Healey.

I mean, if Snoop Dogg can be Snoop Dogg...
