Sooooo......A contractor is drilling underground

to lay some fiber optic cable. His crew stomps all through the wife's flower garden, digging holes to assure that they have not hit incoming water and gas lines.....but not the sewer pipe because it was buried too deep and they assured us that it couldn't be hit.

Well, you guessed it, they drilled straight through a 4" cast iron sewer pipe...... and then ran the cable through it!!!

The city just left after digging out the old pipe and repairing it to the tune of somewhere north of $5K, which they will bill the contractor for.

And I intend to bill him for my plumbers cost, damage to my yard and the loss of a maple tree, and anything else I can think of. He was impossible to deal with and was a complete A$$.

Oh yeah, he now has to re drill and replace the cable because the city had to cut the cable to get the damaged pipe out.

The city guys were, however, great. They were here within 30 min of my call and had a crew/backhoe here in another 30 minutes. Did the work and were gone in about 5 hours.

Also had a rep from all of the companies who had or might have had any underground facilities, including AT&T, Time Warner, etc.

Back in my hole now.

If the city cut a fiber optic cable, that is going to be a bear for the contractor to repair. I believe if we cut a FO cable, its $10k to repair.

Go gettim Jim, my guess is there will be a couple of guys looking for a new job.

We talked to the NC State guy who issued the contract. He came by to inspect for himself and brought the contract with him. Contractor has totally violated the contract regarding how and where to lay the cable, and is many feet outside the street right of way. Looks like AT&T is going to be responsible to straighten this out or get no more approvals from the state for future projects. Or so says the State guy. We'll see.

Several years ago (I'm thinking about 10) Norfolk Southern had an accident in the small town of Creekside. A small thru-truss bridge collapsed under 3 cars of a loaded coal train, rolling the cars on to their sides into a creek. R. J. Corman brought out their side boom tractors to clean up the mess. Indiana County had a brand new treatment plant next to the tracks on the west side of the bridge. When NS brought in large cranes to install the new plate girder bridge, they shattered several underground pipes for the plant. NS and the county fought over who needed to fix that for months... NS lost but it amazed me that they fought it at all. Wish I could find my pictures from that.

Probably as much to try to avoid setting a precedent of admitting that type work caused a problem as to try to avoid the cost.

Found a picture of the aftermath... Not a good picture of the area but a good one of the bridge. 2001EasterSundayCreeksideDe.jpg

I put a plea out on a yahoo group to see if anyone had a pic. Only one that was found.

AT&T rep came by this AM, wants to make this right. Sub who did the damage called this PM wanting to know how big a check they should write.
So now I am wondering what don't I know, and what should I know about the situation that everyone seems to be eager to fix as quickly as possible?
There are at least 2 other underground cables that are on my side of the right of way that I could cause to be removed or demand payment for the use of my land. Think that is it?
