Neighbor has a large, old tree with five trunks growing out of one root ball. Two of the trunks are dead, two more dying. Parts of the upper tree have been falling for a couple of years but she will not have the tree taken down.

Well, last night about 12 am, one of the trunks let go and took out power lines for three houses. I still have power but just barely. Lines are off of the house and have strained, or are straining, the meter can.

So, here I sit, waiting for the electrician to come and put it all together again.

Lack of power for the A/C in this heat is no fun.

Oh welllllll..........
 
bgbassplyr, i know zackly how ya feel! id been telling the nucklehead across the street from me for over a year that his large tree would soon be falling on top of the power lines and into my front yard and thats zackly what happened this past nov. while he and his wife were in fla., i had large broken branches stuck in my front lawn a huge indentation from the trees trunk and lost power most of the day, the crew he hired to remove it busted up a couple of my trees while moving thier bucket around and left a mess in the street and in my yard, it took me 2 days to clean up, what do expect he races a ferrari. :rolleyes:
 
I would say your neighbor in both your cases needs to fund you for the damage that was caused by his/her negligence. I know if it were me I would be looking to neighbor to defray my expenses. This is my humble opinion and not legal advice.

I've always been blessed with good neighbors; 'cept the idiot that throws limbs over my fence. I always just toss 'em back.

judo, thanks for the advice but this guy is a huge "hump" in the road, i lent him my elect. drill and 5 brand new drill bits, he returned it with just one drill bit fully covered with alum. rivit heads and never thanked me, he also told me that my son threw a rock into his front window but we later were told by the police it was an upset girlfriend, he does have a wife, i dont need his money, i need him to move!! :yesnod:
 
To the best of my knowledge, in NC anything that falls over the property line becomes yours. She hired people to clean up and they told me that they couldn't clean up the stuff in my yard. I told them that if they didn't clean it up, to watch out for it coming over the fence, and that I would not be responsible for any injuries.


They cleaned the tree from my yard.

. . . . and he didn't burn out the drill motor? Consider yourself lucky! I learned a long time ago not to loan tools, and not because I'm not friendly. If a neighbor needs a tool to do something, I generally will do the job for him, unless it's unreasonable, or dangerous.

This is true, legally and you are fortunate that they cleaned up. I know it sounds crazy. We had some trees come down in June, during severe wind storms. This included my trees on the neighbors yard and vice versa. We both had to file claims to clean up each other's trees.

This is true, legally and you are fortunate that they cleaned up. I know it sounds crazy. We had some trees come down in June, during severe wind storms. This included my trees on the neighbors yard and vice versa. We both had to file claims to clean up each other's trees.

that was a very big deal after the hurricanes in Florida Charlie/Francis/Jean - we (our church) cut hundreds of trees and removed them for folk who could not afford to or were getting gouged.

What a very nice thing you did? a tip of my hat!
 
thanks - wasn't actually my idea - though I did wield a chainsaw, we had a couple guys from the church who were very good, others like me who weren't afraid to cut and a bunch others who could move branches and stumps, we even ended up in Mississippi after Katrina doing our best to refill the state's low spots one limb at a time - it was a good experience
 
My "ownership" is a $5K vacancy where a tree used to be.
