Backing out of an ebay deal

SYDNEY, Australia (AP) - An Australian court ordered a man to hand over a vintage plane worth about $215,000 after he tried to back out of an eBay auction, a newspaper reported Friday.

The New South Wales state Supreme Court ordered Vin Thomas to complete the deal after he changed his mind about selling the 1946 World War II Wirraway plane he had placed on the Internet auction site last year, the Sydney Morning Herald reported.

Peter Smythe, a Australian warplane enthusiast, was the only person to bid on the item, matching the $128,640 reserve price just moments before the auction ended in August last year.

But Thomas had already agreed to sell the plane to someone else for $85,800 more than Smythe's offer, and backed out of the sale, the newspaper said.

Smythe took Thomas to court, hoping a judge would force him to follow through with the deal.

Judge Nigel Rein agreed, saying the eBay auction formed "a binding contract between the plaintiff and the defendant and ... should be specifically enforced."
 
Nice to see the "Good Guy" come out on top for once.
I had a guy win an auction from me - never saw a cent,
& had to pay $20 to get my bad feedback (& his)removed.

Russ, By the way, how much did it cost you all together to sell your car on Ebay? I see some guys complaining that it is $85.00 just to list it as a straight auction style listing and the cost climbs with the higher reserves. Is that true? Did you have to pay a final value fee as well for a percentage of the final amount?

The last time I sold a Car on ebay was approx. 2yrs ago to the tune of Over $23K: The Total cost to me was $47.00:

My auction started out to cost me $47.00: I get My Invoice from ebay & I`m at $97.00!! Not a Happy Camper but where can you get this much advertising for $97.00?

The Final Value figure; I believe; Is based on What the "Reserve Price Is"? Or; Perhaps, What the Item actually Sold for? I`m really not certain but I surely was Un-Pleasantly Surprised:

Ebay surely has gone up considerably in their costs but What the heck else is new in this World? I know for certain; My Wallet can`t keep up with All the "B__LL S___T" thats going on in this World these days!!

Sorry to sound so Down on the US but Its True!! Just look around You: Whats going down besides the $$$ in Your back pocket!!!!!!

If the buyer backs out Ebay will give back your fees.....

Its just part of the game , never believe a car was sold on ebay unless you personally know the buyer-seller,
Many cars are bid on and not picked up for many reasons ,

Its only a "sale" if the money is exchanged /bcforum/images/%%GRAEMLIN_URL%%/smile.gif

I do not buy cars on ebay , I want to be in charge of my future and not pushed into buying something because the auction is ending or there is "another" buyer (real or not)

eBay Motors fees are explained here:

Bascially, there is an insertion fee ($40) and a fee ($50) once an item has a bid (or reserve is met on a reserve auction). There are also fees for 'extras', the most common of which is setting a reserve.

If you do not read the fees before listing you may be surprised by the final bill but I don't see how you have reason to complain.
 
I wonder what percent of LBC owners on this forum got their cars through Ebay?

...was an eBay purchase. Bought it sight-unseen. I wasn't really looking for one but my wife goaded me into bidding.

No one else was bidding (possibly because it was on an island in the Pacific ocean) and voila! it was mine.

Turned out to be a *lot* better than expected.

Purchased:
1969 TR6
1977 TR7
1972 TR6 ( currently owned )
another 69 TR6
1999 Dodge coversion van
1999 Dodge Dakota
2000 Ford Van
2001 Honda Oddyssey ( 2 weeks ago )

and sold:
The 77 Tr7
Both 69 TR6's
1975 TR6

all with no hassles knock on wood.

Sold my TR3, and then bought the TR8 on Ebay. No complaints, although, as expected, would like to have gotten more for the 3, and paid less for the 8!

Still, Ebay opens many opportunities not found in other methods. As usual, buyer and seller beware...
 
I've bought 3 Triumphs so far on eBay. The TR3 I think was an outstanding deal for me, mostly because the seller did a very poor job of presenting the car. I may have been the only buyer persistent enough to actually see the car before the auction ended.

The Sports 6 was an outstanding deal for the seller; who substantially misrepresented the car's condition. I should have walked away when I went to pick up a "running" car and found that it had no battery, no fuel, and had been dragged bodily from the barn.

The Stag was somewhere in between. Turned out to have a lot of undisclosed problems, but I believe the seller was unaware of most of them.

Of course, my experience with the VTR classifieds has been even worse. I did walk away after towing a trailer 2000 miles to pick up a "surface rust" TR3B that turned out to have a fender that fell off because the Bondo wasn't strong enough, and golfball-sized holes in other places.
