Three questions:

1/ Is there a reason why the folding passenger side seat can’t/shouldn’t be used on the driver side. The bottom "pan" of my driver side seat is cracked and rusted and it would be nice to replace with a folding seat rather than the original fixed one.

I would like to reuse the upholstery so it matches my passenger side seat.

2/ Is the replacement seat from Moss the same size and shape as the OE seats?

3/ Is seat back upholstery the same for both driver and passenger side seats?
 
No, don't know, yes.

For many years I had the folding seat on the driver's side just because I knew no better (pre-internet for one thing). I even added a couple of hardwood shims on the metal pads that the seat leans back on to make it more upright for a driving position I preferred.

Do not have experience with the repro seat pan/frame.

I recall no difference d/s & p/s on the TR3A.
 
I intentionally have the folding seat on the driver's side. I just like it there, and at 6-5, it allows me to sit a little lower. (Fewer bugs in my little bit of hair)
 
Be aware that "cracked and rusted" is pretty standard. Many TR3 drivers of another era would have frowned on using the top just to fend off a little sprinkle. The cracks can be welded. If it's surface rust, that can be removed and repainted with superior coverings used now.

You can certainly substitute a folding seat for the driver's side. The upholstery kits won't distinguish driver's from passenger's. The differences are accommodated by the method of attachment, side to side.

I would, personally, want substantial confirmation before assuming any of the reproduction seats afloat are a satisfactory match to the originals.
 
I replaced my "fixed back seat" from Moss 4 years ago and it was pretty much the exact replacement. Not cheap.........but a lot more solid than the one I replaced.
